Article 1 General - Application of the GTC

These general terms and conditions of sale apply, without restriction nor reserve, to all sales concluded between Arthur's Cellar and buyers wishing to acquire products offered for sale on the website www.arthurscellar.com

The click of the confirmation of the order implies full acceptance of these terms by the customer.
In the absence of any other written agreement between the seller and the customer, these Terms and Conditions shall prevail. Except in specific cases, there is no handwritten signature of this document which concludes the sale, so the confirmation of the order by the customer constitutes acceptance of the content of the GTC.
In case of modification of the GTC, those that are visible on the site at the date of placing the order are the ones to refer to.
These GTC are governed and subject to the application of Swiss law.

Our offers are exclusively reserved for major and capable clients (this implies not being under guardianship or curatorship).
In accordance with article Art.13681 CP of the Swiss law, the sale of spirits, aperitifs and alcopops in a quantity that is likely to endanger health is prohibited to persons under eighteen years old (18 years old).
The sale of wines, ciders and beers is prohibited to persons under sixteen (16 years old). The buyer undertakes to certify that he has the minimum legal age required.

Except for professional buyers, the resale for commercial purposes of items purchased on the Arthur's Cellar site is prohibited. Business customers must identify themselves to Arthur's Cellar. An additional payment period may be granted within the legal limits. This period is written on the quote and it is subject to prior approval of the professional. The quote is valid for thirty (30) days from the date of issue. Acceptance of the quote and order is valid for acceptance of these Terms and Conditions.
The order will be prepared once the quote is signed by the professional client and all the elements necessary for the preparation of the order have been provided to Arthur's Cellar.
Late payment penalties are due from the day following the payment date on the invoice.

Article 2 Validation of the order - terms of payment

Orders are final and are prepared only after receipt of payment and full details of the buyer and the recipient of the order. The preparation of the order depends on the receipt of all these elements. If any items are missing, no delay in delivery could befall Arthur's Cellar.

Credit card payments are secure thanks to the Datatrans system. Arthur's Cellar does not store any of the banking data communicated during Internet purchases. This data is of course not visible online.

The full amount of the order must be paid upon confirmation of the order by the customer before delivery.
Arthur's Cellar reserves the right to refuse to complete an order for a customer with whom an ongoing dispute has not been resolved.

Arthur's Cellar issues an invoice. It remains available on the site in the "my account" section. A copy is also sent by email to the customer with the order confirmation.

The wines remain property of Arthur's Cellar until full payment of the bill. This right of ownership is valid until the balance of the order. It allows to resume, if necessary, possession of the products concerned.

Our offers are within the limits of available stocks. The availability of products is indicated on the site at the time of the validation of the order. In those cases where a product purchased has been noted as being in stock while it was exhausted, Arthur's Cellar will contact you within 48 hours to offer you a replacement or to agree a refund.

Article 3 Rates

Prices are in Swiss Francs (CHF). They include VAT.

In the case of business accounts, prices will be displayed tax-free after logging into your account.
The payment period depends on the conditions of sale that are reserved for you.

The price indicated for each product does not include delivery charges or insurance.
Shipping costs depend on the number of bottles ordered and the destination.
When the customer specifies the place of delivery, the corresponding tariffs are indicated to him.
The order confirmation includes the total amount due, all taxes, shipping, handling, including administrative costs. This price is definitive.
Arthur's Cellar is entitled to modify its rates freely. The applicable rates are those in force on the site at the day and at the time of confirmation of the order, subject to correction of obvious errors and typing errors. Damages in case of manifest error and / or typing errors are excluded.

Article 4 Delivery

Upon receipt of payment and confirmation of the order, Arthur's Cellar prepares your package. Delivery is made to the address indicated on the order form. The buyer must ensure that the details provided are accurate. Arthur's Cellar cannot be held responsible for delivery problems in case of error or incomplete information in the wording of the address on the order form. If the merchandise was returned due to an incorrect or incomplete address, the customer could choose between a new shipment which he will fully bear the costs or the refund of the order after deduction of postage.

Unless otherwise agreed in writing, orders are delivered in one go. Delivery is considered complete upon delivery of the products to the customer. The signature of the buyer is valid as proof of delivery.

Within two months after the presumed date of delivery, except in the case of a call or emails of the buyer signaling a breach in the order to be received, Arthur's Cellar considers that the delivery is made. It is then no longer possible for the buyer to make a claim for non-receipt.

The goods travel at the risk and peril of the buyer. Arthur's Cellar cannot be held responsible for a postal or transportation deficiency.
Any complaints about the quality of the delivery service must be sent by email or telephone to Arthur's Cellar within 72 hours.

It is up to the buyer to check the condition of the goods during delivery and to express any reservations on the delivery note if he notices any shortcomings, breakage or damage. The buyer must also confirm these reservations by sending a registered letter with acknowledgment of receipt to Arthur's Cellar within 48 hours after receipt of the goods.

For deliveries outside Switzerland, it is necessary to contact us by email or telephone.

In case of refusal of receipt of the order by the customer, it will be returned to Arthur's Cellar at the expense of the customer.

Article 5 Delivery time

Arthur's Cellar is committed to do everything possible to ensure that orders are delivered as quickly as possible.
Deliveries do not take place on Saturdays, Sundays, national and cantonal holidays.

The summary of the order specifies the deadline of delivery. In case this period is exceeded for more than 10 days and the exceeding is not justified by a force majeure, the buyer may request the resolution of the sale and the reimbursement of all costs incurred.

In case an order has different delivery times depending on the products, it is the longest delivery period that serves as a reference for the entire order. In case of unavailability of one of the products, Arthur's Cellar will be able to make the delivery in several occasions.
If delivery cannot be made within the specified time, the customer is notified by Arthur's Cellar. He can then cancel his order and get a complete cancellation of the sale. He may request an exchange or a refund in full.
Delivery times run from the reception of the payment and the validation of the order.
If the delivery address has been communicated incorrectly, the buyer alone must bear the consequences (late delivery, extra cost of transport).

Article 6 Legislation for consignments

Orders are subject to Swiss legislation in force.

Internet users placing an order on the Arthur's Cellar website agree to comply with article Art.13681 CP of the Swiss law on the sale of alcohol specifying that the sale of spirits, aperitifs and alcopops is prohibited for persons under eighteen years old (18 years old) and that of wines, ciders and beers is prohibited to persons under sixteen (16 years old). Buyers therefore need to be of the required age to place an order and not to be under protective measures such as guardianship or trusteeship.

For any order destined for a country other than Switzerland, the customer must contact Arthur's Cellar before ordering to inquire about the possibilities of delivery abroad.
Arthur's Cellar has a right of withdrawal if the order is intended to be delivered in a country whose law prohibits the importation of alcohol or wine.
Orders for export are subject to the legislation of the country of destination.

Article 7 Returns

The customer must in any case inform Arthur's Cellar in writing (email, fax, letter) of his decision before returning the non-conforming goods to the order, in order to ensure an optimal follow-up

Products must be returned in their original packaging, in good condition and accompanied by the invoice

Any product consumed wholly or partially will be deducted from the refund amount.

Article 8 Litigation

These conditions of sale are subject to the application of Swiss law. All disputes are exclusively subject to Swiss law. The court in jurisdiction is determined by the law. It is located in the canton of the headquarters of www.arthurscellar.com,namely the canton of Geneva.

In case of disputes, the buyer must first contact Arthur's Cellar to agree an amicable solution.

Article 9 Exhaustion of stocks

All wines sold by Arthur's Cellar are kept in our premises. Reserves are therefore managed live, without intermediary. Products are offered for sale while supplies last.
If during the preparation of the order the products are damaged or destroyed and are therefore out of supply, Arthur's Cellar offers a vintage of quality of equivalent or greater value.

Arthur's Cellar undertakes to communicate these possible unforeseen events as soon as possible and to make every effort to provide an equivalent solution. The buyer may request the partial or total cancellation of the sale if the replacement products do not suit him. He waives all claims for damages.

Article 10 Limitation of liability and warranty

Our products have a guarantee against any hidden defect rendering them unfit for consumption, within 30 days of the sale. For this, the product(s) must be returned to us in their packaging and original condition.

In case of misuse, poor conservation or negligence on the part of the buyer, the warranty does not apply. Arthur's Cellar may ask to appraise the wines that are the subject of the dispute.
Rare wines and vintages of more than 10 years cannot claim a guarantee to the extent that they are offered for sale on their only criteria of notoriety.

Article 11 Non-contractual photos

The photos are illustrative and have no contractual value.. Photo credits are mentioned under each photo or, if the mention is not worn, are the property of Arthur's Cellar.
